How VitalDrip LLC (doing business as ClearTrace) (“ClearTrace”) handles copyright notices: how we file notices on behalf of creators, and how to report infringement on, or dispute a notice involving, our own service.

1. How we file notices for creators

Each notice we send for a creator contains the elements required by 17 U.S.C. § 512(c)(3):

  1. a physical or electronic signature of a person authorized to act for the copyright owner;
  2. identification of the copyrighted work, such as links to the creator’s original posts;
  3. identification of the infringing material and its location (URL);
  4. contact information for the complaining party;
  5. a statement of good-faith belief that the use is not authorized by the owner, its agent, or the law;
  6. a statement that the information is accurate and, under penalty of perjury, that the complaining party is authorized to act for the owner.

Notices go to the host’s designated DMCA agent where one is listed (for example in the U.S. Copyright Office’s DMCA Designated Agent Directory) or to the host’s published abuse or copyright contact.

2. Our good-faith standard

We send notices only for creators who have verified their account and signed our DMCA authorization. Creators confirm they own or control the rights in each work. Automated matches are flagged for review, and we consider whether a use may be licensed or fair before sending a notice. We do not send notices meant to suppress criticism, commentary or other lawful speech. We will withdraw any notice we learn was sent in error. Misrepresentations can create liability under 17 U.S.C. § 512(f).

3. If you received a notice from ClearTrace

If you believe a notice we sent targeted material that is not infringing (for example, it is licensed, it is your own original work, or it is a fair use), email contracts@vitaldripllc.com with the notice details and your explanation. We will review it promptly and withdraw the notice if it was sent in error. You may also send a counter-notification to the service provider that removed the material, as described in section 5.

4. Reporting infringement on ClearTrace

ClearTrace does not host user-uploaded media. If you believe material on our website infringes your copyright, send a written notice to our designated agent containing the six elements listed in section 1.

Designated Copyright Agent
Sean Williams, VitalDrip LLC (doing business as ClearTrace)
2323 Piedmont Rd NE, Apt 3220, Atlanta, GA 30324
(954) 908-9030
contracts@vitaldripllc.com

VitalDrip LLC (doing business as ClearTrace) is registering this agent with the U.S. Copyright Office’s DMCA Designated Agent Directory.

5. Counter-notification

If material you posted on our service was removed because of a notice and you believe this was a mistake or misidentification, you may send our designated agent a counter-notification under 17 U.S.C. § 512(g)(3) that includes:

  1. your physical or electronic signature;
  2. identification of the material removed and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the U.S., any judicial district where we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We will forward the counter-notification to the original complainant. We will restore the material in 10 to 14 business days unless the complainant first tells us they have filed a court action seeking to restrain the alleged infringement.

6. Repeat infringers

Where appropriate, we terminate the accounts of users who repeatedly infringe copyrights. We also suspend or terminate accounts that repeatedly submit false or abusive takedown claims.
